Payment Terms

1. Introduction

By proceeding with your payment, you agree to be bound by these terms and conditions.

2. Third-Party Payment Processor

We utilize Adyen, a third-party payment processor, to securely handle your payment transactions. By proceeding, you understand that your payment information will be subject to the terms and conditions of the third-party processor. You further acknowledge that we shall have no liability in relation to any information, software, products or other material located on the website of such third-party processor.

3. Payment Information

You agree to:

1- Provide accurate and up-to-date payment information, including but not limited to credit card / debit card details, billing address and contact information.

2- Utilize payment cards or similar instruments strictly in your own name.

You further undertake that any payments made by you to purchase a unit or related products and services are made in your own name and not on behalf of any other person or entity. You acknowledge that we will not be obligated to verify these details and we further reserve the right to accept or reject any payments made at our own discretion.

4. Payment

It is your responsibility to ensure that you possess sufficient funds in your account when proceeding with any payment. You will be notified in the case of an outstanding, incorrect, rejected or declined payment, for which you may be liable to pay late payment interest pursuant to the terms of your sale and purchase agreement (SPA) with us.

Any failures or interruptions in processing payments resulting from service interruptions or technical difficulties will not release you from your payment obligations. You agree to indemnify us from any liability, claim, loss, action, damage or expense arising out of your obligations under this section.

If a payment is proven to be unauthorized, fraudulent or incorrect pursuant to Adyen’s guidelines, such payments may be reversed into your account. You acknowledge that payments received from you may, at our sole discretion, be adjusted against any of your outstanding amounts with us.

Except in respect of payments made towards an expression of interest (EOI), where any applicable payment processing charges may be borne by us at our discretion, you acknowledge that you shall remain responsible for any bank charges, payment processing fees or similar costs arising in connection with payments made by you.

5. Security

You acknowledge the risks associated with online transactions and agree not to hold us or our subsidiaries, affiliates, shareholders, directors, representatives, agents or employees liable for any claim, action, demand, damage or loss arising from or in relation to the processing of your payment.

6. General

1- You undertake to immediately notify us in writing of any change to your personal information.

2- We retain the right to suspend, terminate, alter or discontinue this service (whether temporarily or permanently) at any time and for any reason with notification to you. In such cases, you will be obliged to make the payment(s) to us through alternative means, as communicated by us from time to time.

3- We may send you an electronic receipt of your payment to your email address within five (5) working days of receiving such payment from you. It is your responsibility to maintain documents and receipts evidencing payments made to us.

4- These Terms and Conditions are supplemental to those stated in your SPA.

5- You will be responsible for all activity that occurs under your account. You therefore agree to maintain the security and secrecy of your account, username and password at all times.

7. Changes to Terms

We reserve the right to modify these Terms and Conditions from time to time. The amendments will be effective immediately upon the posting of such amended or updated terms on our website. Your continued access or use of the services after such posting confirms your consent to be bound by the terms, as amended.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the laws applicable in the Emirate of Dubai and the Federal Laws of the United Arab Emirates. Any dispute arising from or in relation to these Terms and Conditions shall be referred to the exclusive jurisdiction of the Dubai Courts.
